Rosen Joins Amicus Brief Urging Supreme Court to Reverse Dangerous Ruling Threatening Access to Mifepristone & Upending FDA Approval Process

Rosen Joins Over 250 Colleagues Asking Supreme Court To Grant Emergency Relief From The Recent Court Rulings Threatening Access To Medication Abortion For Millions Of Women 

WASHINGTON DC – U.S. Senator Jacky Rosen (D-NV) joined colleagues in an amicus brief to the U.S. Supreme Court urging it to reverse the recent court ruling that overrides scientific judgment and suspends the Food and Drug Administration’s (FDA) more than 20-year-old approval of the abortion medication Mifepristone, as well as another decision which significantly restricts access to the abortion medication nationwide. 

“The recent anti-choice court rulings don’t follow the science; they are ideological attacks on reproductive rights and attempts to ban abortion access for women in states like Nevada,” dijo el Senador Rosen. “While I’m urging the Supreme Court to reverse these disastrous decisions, we know we can’t expect the Court to protect reproductive freedoms. That’s why I will continue fighting to protect access to abortion medication and ensure reproductive rights are protected by federal law.”

If the district court ruling were left to stand and go into effect, the brief emphasizes that not only could patients in every state be denied access to a leading drug used in medication abortion, the most common form of abortion care, but the FDA’s authority to determine the safety and efficacy of other drugs would be put at risk, threatening patients’ access to all manner of other medications.

The lawmakers conclude by asking the Supreme Court for emergency relief from the decision, writing: “Therefore, emergency relief from the order is necessary to mitigate the imminent harm facing members of the public, many of whom rely on the availability of mifepristone for reproductive care—and many more of whom rely on the integrity of FDA’s drug approval process for continued access to life-improving and lifesaving drugs. Congress intended to—and did—vest authority in FDA to evaluate and ensure the safety and efficacy of drugs in the United States, and Amici call on this Court to give due weight to that intent.”

In the face of attacks, Senator Rosen has been a leader in fighting for women’s reproductive rights. Last week, Senator Rosen signed onto an amicus brief urging the Fifth Circuit to prevent the Texas district court ruling from taking effect. Senator Rosen recently condemned the ruling by the Federal District Court in Texas that would effectively ban access to Mifepristone, as well as the U.S. Court of Appeals decision that severely limits access to the abortion medication. Last month, Senator Rosen helped introduce the Women’s Health Protection Act to enshrine Roe v. Wade in federal law and protect millions of women’s access to reproductive health care.
